Giveaway Terms and Conditions

1. Eligibility: This giveaway is open to individuals who are 18 years or older and are residents of Florida. Employees of Happy's Home Centers, Inc., its affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members are not eligible to participate.

2. Sponsor: The giveaway is sponsored by Happy's Home Centers, Inc., located at 3940 S. Dale Mabry Hwy, Tampa, FL 33611.

3. Agreement to Rules: By participating, the contestant agrees to be fully unconditionally bound by these rules, and represents and warrants that they meet the eligibility requirements. In addition, the contestant agrees to accept the decisions of Happy's Home Centers, Inc. as final and binding as it relates to the content of this giveaway.

4. Giveaway Period: Entries will be accepted online starting on June 1st, 2024 and ending June 15th, 2024. All online entries must be received by 11:59pm Eastern Time.

5. How to Enter: The giveaway must be entered by commenting on the post with a dollar amount between $1.00 and $500.00. The entry must fulfill all giveaway requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Happy's Home Centers, Inc.

6. Prizes: The winner(s) of the giveaway (the "Winner") will receive 5 cubic foot Chest Freezer and Contents. The specifics of the prize shall be solely determined by Happy's Home Centers, Inc. No cash or other prize substitution shall be permitted except at Happy's Home Centers, Inc.'s discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winner. Winner is responsible for claiming the prize at 3940 S Dale Mabry Hwy, Tampa, FL 33611 within 14 days of notification to claim prize. Failure to claim prize within the 14 days will results in forfeiture of prize.

7. Winner Selection and Notification: The winner will be the entry that is closest to the actual purchase price of the chest freezer contents. In the event that multiple correct answers are submitted, the earliest entry will win (the entry that was submitted first). If no correct answers are submitted, the winner will be determined by the entry that is closest to the correct answer. The winner will be notified via Facebook Message by June 20th, 2024. Happy's Home Centers, Inc. shall have no liability for Winner's failure to receive notices due to spam, junk e-mail, or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner cannot be contacted, is ineligible, fails to claim the prize within 14 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected.

8. Rights Granted by You: By entering this content (e.g., photo, video, text, etc.), You understand and agree that Happy's Home Centers, Inc., anyone acting on behalf of Happy's Home Centers, Inc., and Happy's Home Centers, Inc.’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.

9. Terms: Happy's Home Centers, Inc. reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the giveaway should virus, bug, non-authorized human intervention, fraud, or other cause beyond Happy's Home Centers, Inc.’s control corrupt or affect the administration, security, fairness, or proper conduct of the giveaway. In such case, Happy's Home Centers, Inc. may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Happy's Home Centers, Inc. Happy's Home Centers, Inc. reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the giveaway or website or violates these Terms & Conditions.

10. Limitation of Liability: By entering, You agree to release and hold harmless Happy's Home Centers, Inc. and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the promotion; (v) electronic or human error in the administration of the promotion or the processing of entries.

11. Disputes: THIS giveaway IS GOVERNED BY THE LAWS OF THE UNITED STATES AND FLORIDA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this giveaway, the participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Tampa, Florida having jurisdiction.

13. Facebook: The giveaway hosted by Happy's Home Centers, Inc. is in no way sponsored, endorsed, administered by, or associated with Facebook.

14. Entires: The giveaway hosted by Happy's Home Centers, Inc. is limited to one entry per person.

15. By participating, You, the Contestant, have affirmatively reviewed, accepted, and agreed to all of the Official Rules.
